     The objective of thiscommittee would be to look into the implications of the North Gauteng HighCourt ruling that has effectively put the brakes on the SA National RoadsAgency Ltd from starting to collect its fees to shore up the R20 billioninvestment on the highways.

     Earlier this yearSANRAL effectively made a shareholders’ call on government that resulted in aR5.8 billion injection.

     in its statement on whyit was downgrading SANRAL, Moodys Investor Services said that the company couldface losses as much as R100 million per month – which meant that SANRAL couldgo bust in as little as two years if it didn’t somehow get additional funding.

     The implications forother stat-owned enterprises is profound and how this will affect their priceof raising funds on the capital markets for the much vaunted R800 billioninfrastructure build programme that government needs to shore up its jobcreation strategy.

      The creation of fivemillion jobs by 2020 was struggling to get off the ground as the country’soverall economic performance remained lackluster.

      So the creation ofthis Cabinet committee to look into just one infrastructure project has a tingeof panic around it.

      The second panicattack was by Agriculture, Forestry and fisheries Minister TinaJoemat-Pettersson who arrived at the Cape Town Press Club breakfast to findthat her nemesis, Democratic Alliance MP Pieter van Dalen, was in the audience.

      instead of wowing heraudience, who were waiting with baited breathe for her performance,Joemat-Pettersson became hooked on Van Dalen’s presence and offered to leave asshe believed that he would use the occasion to make some kind of politicalstatement.

     her media people arguedthat the Press Club was not the place for politicians and media only, but theydid not do their research properly, because if they had enquired a bit more, byeven just looking at the club’s website, they would have realized that allsorts of people who have some kind of general media interest are members.

     The Cape Town PressClub is open to anyone and then they played the race card when obviously losingthe debate about whether Van Dalen should be there or not.

     Both events illustratethat there is a woeful lack of proper planning within government. it doesn’tmatter how grand a project or how small an event is – the lack of doing themost perfunctory research and the inability to adapt to changing circumstancesshow a rigidity in political thought that is the real reason for the poorservice delivery being experienced today.

Life-changing bite: Addicted to that Apple

DUBAI: for years, Apple fans around the globe have been flocking to the nearest Apple store on the day of a product launch with the intent of not only experiencing the new product, but also purchasing it. in some cases, like in China, fans rioted when the launch of the iPhone 4S was delayed for no apparent reason.

Closer to home, UAE Appleheads don’t riot, but they are no less passionate.

Jimmy Grewal, a 34-year-old Indian and Executive Director at Elcome, once flew from Dubai to Boston to buy one of the first Apple Newton MessagePads and took a flight back the next day. That was in 1993. he has been collecting Apple products since 1995 and now owns around 40 of them. for daily use, he has a MacBook Air, a Mac Pro, an iPad, an iPhone 4S, and an Apple TV.

"I’ve done some crazy things to get my hands on Apple products; I’ve travelled to Apple events around the world since I was 14. Luckily, that led to a job developing Mac software at Microsoft, otherwise I would have a hard time justifying the time and money I spent satisfying my obsession," Grewal said.

But has he managed to convert anyone into using Apple?

"I’ve been using Apple products for almost 30 years and have probably converted hundreds of people into Apple customers. The most challenging was my mother, who now uses an iPhone even though she blames Apple for ruining my eyesight and ‘wasting’ so much money."

Fouad Abu Kishk, a 32-year-old Jordanian and Partner and CEO of UTech, a company that specialises in mobile and tablet applications, as well as the proud owner of an iPod touch, iPhone 4S, iPad 1, iPad 2, and waiting on the third, received his first Apple product in 2010 when a friend presented him an iPhone 4. "When I got it, it came naturally to me, it made sense – it’s the best phone I’ve ever had."

He felt compelled to convert the people around him and recalls with fondness an altercation he had with a BlackBerry user. "he was having trouble with his phone … naturally I suggested he buy an iPhone, but he refused to give it up for the messenger. I tried to make him understand why an iPhone was the better choice, but it seemed like it was of no use. Three days later he walked in with an iPhone saying: ‘I don’t want to hear a word about it’."

Fouad readily gives away the older version of any given device to non-Apple users as soon as he’s bought its latest upgrade, in the hope of converting them.

Speaking from an expert’s point of view, he added: "When I call in my team to brief them about a new project, they always get excited about the Apple part of the work to be done. They really enjoy building apps for the iOS platform, which is the operating system for Apple’s iPod Touch, iPhone and iPad. It’s a completely different development philosophy, building apps that centre around the user experience. in fact, Apple’s entire success revolves around the user experience. The sheer attention they place in every detail of their products is felt by their customers and is the reason why they have massive sales every year and a fanatical following. If other businesses in other industries were to adopt Apple’s values in business, the world would truly be a better place."

On the hospital floor

Sana’a Diab, a 26-year-old Palestinian, and a business development executive, has a unique story to share about Apple. "At the time of the second iPad launch, my sister was giving birth in the hospital. I had to be with her, but I also had to watch the launch live. so, I sat on the cold hospital floor, connected to wireless internet and accessed three websites with live blogs on my little iPhone’s screen to see what was happening – it was worth it."

The 26-year-old owns a Macbook, an iPad, an iPhone, two Magic Mouses, two Trackpad, two wireless keyboards, one wired keyboard, one iPad keyboard, one Apple TV, one Airport, and two iMacs.

Like Jimmy, Sana’a has lost count of the number of people she has converted. "I converted many, especially to the iPhone and iPad."

Assia Merazi, a 23-year-old Algerian and a graphic designer, got converted into an Applehead when she purchased an iPhone 1 – she has not looked back since. "When other smartphone users have problems with their device I definitely have to point out that an iPhone wouldn’t do that. also, many apps on iPhone tend to give you exactly what you need instead of always having to search for it online."

She owns five devices and, like any other Apple fan, has managed to convert her family and friends. "I managed to get my brother, mother and three friends to use Apple products."

For 23-year-old Nilofar Khateeb, also a graphic designer, the conversion took place in 2007, when she enrolled to study visual communications: "I switched from PC to Apple, and I couldn’t go back. since I started using design software, I realised how easy and quick Apple was to use and intuitive, too. I even managed to convert some of my family members into using Apple products; they’re all on the iPhone now."

Nilofar has an iPad 2 and an iPhone 4S, however, she fully intends buying the latest of both devices when they’re out.

And soon, the new iPad will hit the UAE shores – officially.

Dewey and LeBoeuf prepares to liquidate U.K. office

Dewey & LeBoeuf LLP is preparing to liquidate its U.K. office while its U.S. practice tries to collect its bills and preserve its business, a firm executive and two people familiar with the situation said.

The New York-based law firm’s London office appointed a committee including restructuring lawyer Mark Fennessy and banking lawyer Bruce Johnston to review its options to wind down or close the business, said the people, who declined to be named because the matter is private. More than 25 partners work at Dewey’s London operation, out of about 300 partners worldwide before a round of departures, said one of the people.

In New York, the firm is near an agreement with banks about extending a credit line and plans to stave off bankruptcy by collecting bills to pay lenders and transferring employees and property to other firms, said Martin Bienenstock, one of four members of Dewey’s chairman’s office. Dewey is talking with potential merger partners and its lenders are being cooperative, he said.

“Bankruptcy is always a last resort and is not in current plans,” Bienenstock, who heads Dewey’s restructuring group, said in an e-mail Tuesday. “If real property and equipment leases are assumed by other firms or renegotiated, and the lenders realize on their accounts receivable and inventory, there may be no need.”

Dewey has drawn about US$75-million of an available US$100-million on the credit line, according to a person familiar with the firm’s finances. about 85 partners have left the U.S. firm in recent weeks.

Angelo Kakolyris, a spokesman for Dewey in the U.S., didn’t return a call seeking comment. Calls and e-mails to Fennessy and Johnston weren’t immediately answered. Peter Sharp, the managing partner of the London office, didn’t reply to requests for comment.

Dewey’s U.K. partnership, which also covers its Paris office, is a separate legal entity to the firm’s U.S. limited liability partnership, so a decision on whether to file for so-called administration can be made separately.

The firm said in an internal memorandum on April 29 that New York prosecutors were probing possible wrongdoing at the firm. the memo said that Steven Davis, formerly sole chairman, was ousted from a five-person chairman’s office and the executive committee.

Davis hired criminal defense attorney Barry Bohrer, a partner at Morvillo, Abramowitz, Grand, Iason, Anello & Bohrer, as he faces allegations of misconduct.

“Every action of mr. Davis as chair of the firm was taken in good faith and in the best interests of the firm,” Bohrer said in an e-mail confirming his retention. “He is confident that fair-minded professionals will conclude that he engaged in no misconduct.”

The turmoil at Dewey has upended the firm’s plans to find a merger partner and sent prices of its bonds reeling. the privately placed debt, issued in 2010 to refinance older bank loans and once valued at 100 cents on the dollar, were seen to trade April 27 in the 60s, said Kevin Starke, an analyst at CRT Capital Group LLC.

“If the firm reorganizes, the loan and the notes could be money good, but if it liquidates, it will come down to the valuation of accounts receivable,” he said, referring to Dewey’s bills to clients for legal services. CRT, which trades distressed debt, didn’t handle the sale of Dewey bonds by an investor last week, he said.

Dewey management sent another memo to all the firm’s partners Monday informing them they are free to explore other job opportunities, said a person familiar with the contents of the document. the firm is carrying on business as usual and at the same time trying to find employment for legal and non-legal staff, according to the person who saw the memo and who declined to be identified because the information is private.

“Our memo did not encourage people to leave,” Bienenstock said Tuesday in his e-mail. “Rather, it explained that the partners who do not want to be part of a merger could look elsewhere. this way they would not be otherwise inhibited by duties to the partnership.”

The firm said Tuesday in an e-mailed statement that health insurance coverage for its partners and employees had been suspended.

“A payment routing issue involving the agent and the insurer resulted in a temporary, very short-term suspension of medical coverage,” according to the statement. “The firm has paid its premium and is actively working with the insurer to restore full coverage to partners and employees as soon as practicable. Health coverage will be restored.”

Dewey’s talks with Greenberg Traurig LLP about a possible merger fell apart this week, Dewey said. no single firm currently appears willing to buy all of what is left of the firm, said a person familiar with the situation. Dewey now is talking with several firms that might take parts of its specialized practice groups, as part of a plan devised with lenders’ consent, said the person, who declined to be named because the talks are private.

Patton Boggs LLP, based in Washington, is among the firms conferring with Dewey, said the person. Under Dewey’s plan, different firms might pay to acquire receivables generated by lawyers they took on, he said. the law firm does have something to sell — groups of strong practices, he said.

Dewey’s most profitable practices include bankruptcy, corporate law, litigation and public policy, the firm has said.

The plan remains uncertain because firms considering taking some of Dewey’s lawyers might do better to pick up the pieces after a bankruptcy filing, the person said.

Patton Boggs wouldn’t say if it will take on some of Dewey’s lawyers.

“From time to time we have conversations with other firms in connection with our interest in making strategic acquisitions to strengthen our practice,” said Patton Boggs Managing Partner Edward Newberry. “We have only the highest regard for the lawyers at Dewey & LeBoeuf. they have a legacy of being among the very best in the areas in which they practice.”

SNR Denton, which has headquarters in Washington and London, is also in talks with Dewey on a possible merger, according to a source familiar with the discussions. the firm declined to comment.

“We enjoy strong relationships with many law firms around the world,” said Jeff Scalzi, a spokesman for SNR Denton, in an e-mailed statement. “However, we never comment on rumors about specific discussions or our continuing efforts to enhance SNR Denton’s already robust global presence.”

Since Monday, at least 15 lawyers have announced departures from Dewey including Marshall Stoddard, the U.S. head of Dewey’s bank and institutional finance practice group, and Charles Moore, an energy partner in Houston, who both left for Philadelphia-based Morgan Lewis & Bockius LLP along with two counsel lawyers and an associate.

Among the departures announced Tuesday is Stuart Saft, co-chair of Dewey’s New York real estate practice group, who’s joining Holland & Knight.

Gibson Dunn & Crutcher LLP hired disputes partner Peter Gray for the firm’s Dubai office, and Clifford Chance LLP hired Howard Adler, co-chair of Dewey’s compensation and benefits practice and Gary Boss, a partner who specializes in mergers and acquisitions and insurance. Dewey partner Gary Apfel, co-chair of the consumer financial services group, also announced his departure Monday to Philadelphia-based Pepper Hamilton LLP to lead that firm’s California expansion.

So You Want to Be a Motorcycle Courier?

I’d been thinking about becoming a motorcycle courier for a while and then at the end of 2009 along came the postal strikes, my opportunity. They say a recession is a good time to start a business and after all how hard can it be? I used to deliver pizzas around Exeter in the late 80s on Honda C90s and Melodys but a broken leg put an end to that quite quickly. To be honest, a broken leg was not a bad outcome considering how I used to ride those things After 15 years off bikes while I wasted time with death defying car crashes and a death defying marriage I now had a Honda Pan European ST1100, ideal for long trips to those far flung corners of the UK from my base in rural Devon.

My main role in life is as a single parent carer for my disabled son but while he was at school I was left to fill the days, which I seemed to do by riding somewhere random and then riding back again before he got home. Wouldn’t it be great if I could ride to different places but get someone else to pay for the petrol, tyres and servicing? I live near Exeter and there aren’t a lot of motorcycle courier companies around me so I had a niche market. Then again, you need to ask yourself why there aren’t a lot of motorcycle couriers around. I wasn’t looking for a 24/7 job as I can only work during term time and not really at weekends so the lack of possible demand didn’t put me off.

In October last year I spent about three hours on the ‘phone getting the basic necessities, bike insurance which covered me for being a courier and Goods in Transit (GiT) insurance. Just the bike insurance was a headache, some companies quoted me over 1,500 per year TPF&T and some wouldn’t even consider offering me such insurance. So, with no real planning and my usual jump in with both feet and make it up as I go along attitude I was now a motorcycle courier, albeit one with zero experience, Devon Motorcycle Couriers was born. Good start but how do people find me? where do people look for a courier? In this day and age everyone uses Google. If you want something in a hurry use Google. That is what I assumed and luckily I seemed to be right. First thing to do, find as many free online business directories as you can and get yourself registered with them. It is a slow and laborious process but you’ll be glad later. Don’t be surprised if you get lots of calls over the next few days from the directories asking if you would like to upgrade, for a price. you quickly learn how to say no and hang up. Then what? Sit back and wait? no, keep pushing it There will always be somewhere you can list your business that you hadn’t thought of before.

Within three days of starting the business I had a job from a financial services company based hundreds of miles away who wanted me to print out some forms they emailed me, ride to Plymouth, get them signed and post them back. yes, they called me a) because of the postal strikes and b) because they found my number in one of the free directories I’d put myself on the day before. by now I was finding it inconvenient to ride somewhere and check Google Maps on my ‘phone so I invested in a Viper helmet with an integrated Bluetooth headset and a second hand reconditioned Garmin Zumo GPS unit. now I had my ‘phone, my GPS and my head all connected. I could take calls on the move and listen to directions from the GPS.

I found freeindex.co.uk a free online business directory which didn’t charge me to list my company, they make their money out of adverts on their site. I registered the devonmotorcyclecouriers.co.uk domain and had a redirect set up to my page on the freeindex site. Seeing their site made me look into GoogleAds where you pay only when someone clicks on your advert and comes to your site. like cheesecake this appeared to be the future. GoogleAds is not for the faint hearted and you can easily haemorrhage a lot of money for no real return, so be warned.

For the next few months work trickled in but not regularly, at this stage I was lucky if I got one ‘phone call a week. I didn’t panic, I was just testing the water to see what it was all about. My children kept me busy and I didn’t have a mortgage so it wasn’t a make or break situation. I took some marketing advice and finally got around to making my own website. Luckily I was a web developer in a previous life so I built a simple one page website instead of directing people to the somewhat confusing arrangement I had before.

I had the steady trickle of jobs in the first few months of 2010 ranging from documents from a local accountants up to Companies House in Cardiff to a package from a local manor house up to the owner in London and other things in between. the last few weeks of March were good, as people wanted paperwork delivered to their head offices around the country before the end of the financial year. In April I wanted more than a few ‘phone calls a week so I fine tuned my advertising strategy on Google, upped my advertising budget and things really started to take off. Realising that there was demand for a motorcycle courier in Devon I also arranged some Public Liability insurance, again through mark at Coversure Rubery. This covers me for example, if I put a package on the ground and someone trips over it, breaks their leg and then decides to sue me.

It was around April that I had my weirdest job to date – transporting a live fish from a farm near the M5 in Devon to a testing laboratory just South of Boston in Lincolnshire. It had to be alive when it got there for some tests to be done. Nobody complained so I assume it was still OK. the hardest part of that job was trying to stop the water sloshing out of the fish tank strapped to my seat. (Only joking, it was in a a special fish transportation box about the size of a shoe box). It is now July and I’m probably doing an average of 800 miles a week. Being tucked away down in Devon means most of my work involves distance. Exeter to London and back is roughly a 400 mile round trip. Motorways might not always be the shortest route but they will invariably be the quickest, due to the higher average speeds and they do mean easy money. Tailbacks, should you be unfortunate enough to get one, can give you invaluable filtering practise though. Miles and miles of filtering will make you tired, so stop and enjoy the sight of all those car drivers stuck in their cages before filtering a few miles more.

So what is the ST1100 like as a courier bike? mine is a 1999 ABS-TCS model and I find it ideal, low centre of gravity and the 28 litre petrol tank helps. I can cruise at 90mph from Exeter to London without worrying about stopping for petrol on the way. People say the Pan European is all day comfortable and compared to a lot of modern bikes it is but after 8 hours sitting on a standard seat in the rain, it isn’t I’ve recently invested in an Air Hawk inflatable seat pad which makes the world of difference. People might think I have piles but it does transform my comfort. I bought the bike in April 2009 as an MoT failure with 69,000 miles on the clock, I rebuilt the calipers, changed the brake pads put new tyres on and it was good to go. It has now done over 85,000 miles and I’ve found the traction control system (TCS) especially useful on wet Lincolnshire roundabouts. There seem to be a lot of roundabouts there If you have big feet you will rub the soles of your boots a lot in corners. you have to move your toes onto the footpeg and see if you can grind the hero blobs instead.

The ST is nearly 300Kg fully fuelled so if you push it, the front end will slide, just relax, ease off the throttle and let it do it’s thing, you will get around the corner. the only major failure I’ve had has been the alternator which let go on the way back from Thruxton BSB last year. This was not long after I’d bought the bike and David Silver Spares had one in stock for a lot less money than mr Honda wanted. It was fitted by Bridge Honda in Exeter who I use for my major servicing.

It is a very good bike for getting to London but riding it around the centre of the city on a sweltering hot Friday lunchtime will make you sweat, lots. Don’t try and ride like the other couriers, they ride in London every day. Take it easy and join in where you can, you can’t get a Pan European through that gap you just saw a scooter go through If you are too aggressive in the traffic your clutch will slip and the cooling fan will pump out so much excess heat you’ll think you are in Dubai. Slow and steady wins the race and all that other stuff your Mum told you when you were younger. I’ve had one incident since I’ve been in business and that was when someone on a roundabout put the front of their car through my pannier as I rode past. I didn’t come off but I had to ride home from London with three quarters of my pannier strapped to my seat. I’m now practised in the arts of fibreglass, body filler and florescent yellow paint. I’m just waiting on the new subframe to arrive which I’ll fit in the summer holidays and then nobody can claim not to have seen me.

If you don’t like riding in the rain don’t become a courier, you haven’t got a choice, especially in the UK. Motorways might be a bit boring but they are a good way of getting to major cities quickly. the days can be long, it might be fun riding to the other side of the country but don’t forget that you have to ride home again almost immediately. If you have time after a delivery you can always ride home cross country on A roads to keep yourself amused.

I’m no motorcycle courier expert, these are just things I have learnt in the last 9 months which other people might find useful. I’ve lost count of the number of people asking me for a job since I started the business and I am steadily building a list of hopefuls. If you do get other people to work for you, make sure they are self employed, employing people yourself costs too much money. There are a lot of people out there looking for a free lunch and a company bike.
